Terms of Use

These Terms of Use govern access to and use of websites, customer portals, hotspot, internet connectivity and related services provided by Merger Communications Limited.

Effective date: 1 September 2026

1. Acceptance of These Terms

By accessing our websites, creating a customer account, purchasing a service or voucher, or using a Merger service, you agree to comply with these Terms of Use and any service-specific terms communicated to you.

If you do not agree with these terms, you should not use the relevant service.

2. Our Services

Merger Communications Limited provides internet connectivity and related services, which may include broadband, hotspot, wireless, fibre, installation, network and other communications services.

Service availability may depend on coverage, infrastructure, equipment, capacity, technical conditions and other operational requirements.

3. Customer Accounts

Where an account is required, you must provide accurate and reasonably complete information and keep your account details current.

You are responsible for protecting your password and other authentication credentials and for promptly notifying us if you suspect unauthorised access to your account.

4. Internet Packages and Subscriptions

Package features, speed, validity period, data allowances, priority-data limits, pricing and other service characteristics are those displayed or communicated for the package at the time of purchase, subject to applicable service conditions.

Actual internet performance can be affected by network congestion, customer equipment, Wi-Fi conditions, location, third-party networks, upstream providers, maintenance and other technical factors.

5. Hotspot Vouchers

Hotspot vouchers and access codes are intended for use in accordance with the package purchased and the applicable validity, usage and authentication rules.

Customers are responsible for keeping voucher codes reasonably secure. Merger may restrict, suspend or invalidate vouchers involved in suspected fraud, abuse, unauthorised resale or other prohibited activity.

6. Roaming

Where roaming is enabled for a Merger hotspot service, an eligible voucher or account may be usable across participating Merger hotspot locations.

Moving between locations does not create a new subscription or automatically reset applicable validity, time or usage allowances.

7. Payments

Prices and applicable charges are shown or communicated before or in connection with purchase.

Payments may be handled through approved third-party payment processors. A payment is treated as successful only after it has been confirmed through the relevant payment-verification process.

A payment initiation, transfer instruction, screenshot, browser return page or other unverified indication does not by itself constitute confirmed payment.

8. Billing, Outstanding Amounts and Refunds

Customers remain responsible for valid charges, invoices and other amounts arising from services they have requested or used.

Any refund, credit or adjustment is subject to the circumstances of the transaction, the applicable package or service terms, payment-provider requirements and applicable law.

Requesting account deletion does not automatically cancel valid outstanding invoices, payment obligations or other contractual responsibilities.

9. Acceptable Use

You must use Merger services lawfully and responsibly. You must not use the services to:

  • Commit, facilitate or promote unlawful activity.
  • Gain unauthorised access to systems, accounts, devices or networks.
  • Distribute malware or intentionally interfere with network or service operation.
  • Engage in fraud, impersonation, phishing or deliberate misuse.
  • Circumvent authentication, billing, access-control or security mechanisms.
  • Use the service in a manner that materially disrupts other customers or damages Merger systems or infrastructure.

10. Suspension or Restriction

We may restrict, suspend or terminate access where reasonably necessary because of non-payment, fraud, security concerns, abuse, violation of these terms, legal or regulatory requirements, or protection of our network and other customers.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue.

11. Service Availability and Maintenance

We work to provide reliable services, but continuous or uninterrupted availability cannot be guaranteed.

Services may be interrupted or degraded by maintenance, equipment failure, power conditions, fibre cuts, upstream-provider problems, interference, congestion, force majeure events or circumstances outside our reasonable control.

12. Customer Equipment

Customers should use compatible and properly maintained devices, routers, access equipment and cabling where required.

Equipment supplied, leased or installed by Merger may be subject to additional ownership, warranty, return, maintenance or replacement conditions communicated for that service.

13. Intellectual Property

Merger names, branding, website content, software, designs and other proprietary materials remain the property of Merger Communications Limited or their respective rights holders unless otherwise stated.

You may not copy, misuse or commercially exploit protected materials except as permitted by law or with appropriate authorisation.

14. Privacy

Our handling of personal information is described in our Privacy Policy .

By using our services, you acknowledge that service delivery may require processing account, billing, payment, network, security and service-related information as described in that policy.

15. Account Deletion and Termination

A customer may request account deletion through an available account-management process or by contacting Merger.

Account deletion may disable portal access while the request is reviewed and processed. Certain information may need to be retained for accounting, payment, security, fraud-prevention, dispute, regulatory or other lawful purposes.

16. Third-Party Services

Some aspects of our services may depend on third parties such as payment processors, hosting providers, telecommunications carriers, infrastructure providers or equipment manufacturers.

Third-party services may also be governed by their own applicable terms and policies.

17. Limitation of Liability

To the extent permitted by applicable law, Merger is not responsible for indirect, incidental or consequential loss arising solely from circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude or restrict a right or liability that cannot lawfully be excluded or restricted.

18. Changes to Services or Terms

We may update services, packages, prices, operational rules or these Terms from time to time where reasonably necessary.

The current version of these Terms will be published on this page. Material changes may also be communicated through appropriate customer channels where required.

19. Governing Law

These Terms are governed by the applicable laws of the Federal Republic of Nigeria.

Nothing in these Terms removes rights or protections available to customers under applicable Nigerian law.

These Terms are intended to provide clear operating rules for Merger services and support legal and regulatory compliance. Service-specific agreements may contain additional terms.
